The sources used were media reports, in particular an investigation by Frag den Staat, ARD Kontraste and RBB which published official correspondence on the project between relevant authorities (see links below). This document is intended as a summary and not a political commentary. The descriptions reflect the plans of the authorities and the technical language used does not correspond to our views. The information compiled does not claim to be exhaustive.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Political background and link<\/strong><strong>s between<\/strong><strong> federal <\/strong><strong>and <\/strong><strong>state level<\/strong><strong>s<\/strong><strong><\/strong><\/h3>\n\n\n\n<h4 class=\"wp-block-heading\"><a href=\"https:\/\/fragdenstaat.de\/dokumente\/176968-190116-vorlage-lstabr-briefing-ste-barz-bb-ber-gewschw\/\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>2017: BER as pilot project for planned federal departure centers<\/strong><\/a><\/h4>\n\n\n\n<p>In 2017, the Federal Ministry of the Interior (BMI) proposed to the states (L\u00e4nder) to increase federal responsibility for deportations, including through federal departure centers (detention facilities) at central airports to facilitate charter deportations. The state of Brandenburg (BB) was interested in piloting this. The legal basis for these centers, however, was never established.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><a href=\"https:\/\/fragdenstaat.de\/dokumente\/176968-190116-vorlage-lstabr-briefing-ste-barz-bb-ber-gewschw\/\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>2018\/2019: Replacement for detention facility in Eisenh\u00fcttenstadt<\/strong><\/a><\/h4>\n\n\n\n<p>In February 2017 the state of BB was requested to provide a state-owned detention facility (via a resolution from the Ministerpr\u00e4sidentenkonferenz). The existing facility in Eisenh\u00fcttenstadt had been closed: officially due to not meeting fire safety standards, but according to BMI this closure was for political reasons.<\/p>\n\n\n\n<p>The Brandenburg Ministry of the Interior (with then State Secretary Lange, SPD, today Finance Minister) planned to open a new deportation detention facility near BER Airport. To sidepass the Finance Minister, from the Left Party, the Ministry of the Interior did not want to construct the building itself, but rather have it constructed by an investor and then rent it (see point \u201cInvestor\u201d). The course was set for the project to come.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><a href=\"https:\/\/fragdenstaat.de\/dokumente\/181654-anhang-1\/?page=3\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>New Plan 2020: \u201cArrival- and departure centre\u201c as a European flagship project<\/strong><\/a><\/h4>\n\n\n\n<p>Due to the changed political situation (state elections), the facility was no longer planned as a deportation detention center (\u201cAbschiebehafteinrichtung\u201c, \u00a7 62 Residence Law (AufenthG) paras. 2 [\u201cVorbereitungshaft\u201d] and 3 [\u201cSicherungshaft\u201d]), but as an &#8220;authority center&#8221; (\u201cBeh\u00f6rdenzentrum\u201d) with, among other things, places for deportation custody (\u201cAusreisegewahrsam\u201d \u00a7 62b Residence Act).<\/p>\n\n\n\n<p>In March 2021, <a href=\"https:\/\/fragdenstaat.de\/dokumente\/181733-bebauungsplan-suedlicher-dorfkern-schoenefeld-der-gemeinde-schoenefeld\/?page=1\" target=\"_blank\" rel=\"noreferrer noopener\">the state of Brandenburg explained to the municipal development committee of Sch\u00f6nefeld<\/a> that the plans are for a &#8220;facility that is unique in Europe [\u2026] and that sets new standards for the rapid, networked processing of entry and exit procedures directly at the capital city airport. It is a showcase project of international importance with highest priority at federal and state level.&#8221;<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Seehofer&#8217;s legacy<\/strong><\/h4>\n\n\n\n<p>In October 2021, a <a href=\"https:\/\/fragdenstaat.de\/dokumente\/181629-grundsatzverstaendigung-des-bundesministeriums-des-innern-fuer-bau-und-heimat-und-des-ministeriums-des-innern-und-fuer-kommunales-des-landes-brandenburg-ueber-die-projektierung-eines-einreise-und-ausreisezentrums-am-flughafen-ber\/?page=1\" target=\"_blank\" rel=\"noreferrer noopener\">formal agreement<\/a> was signed between the BMI (Seehofer, still in office on provisional basis after the Bundestag elections) and the interior ministry BB (St\u00fcbgen), stating that the state of BB would be responsible for the construction process and the federal authorities would be renting. <a href=\"https:\/\/www.parlamentsdokumentation.brandenburg.de\/starweb\/LBB\/ELVIS\/parladoku\/w7\/drs\/ab_6500\/6543.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Even the State Chancellery (\u201cStaatskanzlei\u201d) of BB found out about the project only from the press release of the Ministry of Interior.<\/a><\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>What will the deportation center look like?<\/strong><\/h3>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Who will be detained?<\/strong><\/h4>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong><a href=\"https:\/\/www.asyl.net\/themen\/aufenthaltsbeendigung\/abschiebungshaft-und-ingewahrsamnahme\/ausreisegewahrsam\" target=\"_blank\" rel=\"noreferrer noopener\">deportation custody (\u201cAusreisegewahrsam\u201c)<\/a> <\/strong>= detention for a maximum of <mark style=\"background-color:#EEEADD\" class=\"has-inline-color has-black-color\">28 days, \u00a7 62b Residence Law (January 2024 with the so called &#8220;R\u00fcckf\u00fchrungsverbesserungsgesetz&#8221; federal law it was extended from before 10 days)<\/mark><\/li>\n\n\n\n<li>At present no plans for <strong>deportation detention in the sense of <a href=\"https:\/\/www.asyl.net\/themen\/aufenthaltsbeendigung\/abschiebungshaft-und-ingewahrsamnahme\/sicherungshaft\">Sicherungshaft<\/a>\u201d<\/strong>; \u00a7 62 para. 3 Residency Law; detention for up to 18 months, e.g. in cases of an enforceable obligation to leave the country due to unauthorized entry, withdrawal of deportation or suspected risk of absconding). <a href=\"https:\/\/fragdenstaat.de\/dokumente\/181654-anhang-1\/?page=3\" target=\"_blank\" rel=\"noreferrer noopener\">However, this was part of the 2018\/2019 plans and might still be included with a change in political power.<\/a><\/li>\n\n\n\n<li>So-called rejections \/ <strong>refusal of entry (\u201cZur\u00fcckweisungsf\u00e4lle\u201c)<\/strong> = people who are refused entry at airport (e.g. because of missing visa \/ forms etc.) (\u00a7 15 Abs. 6 AufenthG)<\/li>\n\n\n\n<li><strong><a rel=\"noreferrer noopener\" href=\"https:\/\/www.proasyl.de\/material\/abgelehnt-im-niemandsland\/\" target=\"_blank\">Airport Asylum Procedure<\/a> (\u201cFlughafenasylverfahren\u201c) <\/strong>= fast-track asylum procedure (\u00a7 18a AsylG)<\/li>\n\n\n\n<li>Other groups might still be included (e.g. Dublin cases, \u201cAufgriffsf\u00e4lle\u201d)<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>What\u2019s the size of the prison?<\/strong><\/h3>\n\n\n\n<p><a href=\"https:\/\/www.rbb24.de\/politik\/beitrag\/2022\/12\/gewahrsam-asylbewerber-abschiebungen-ber-flughafen.html\" target=\"_blank\" rel=\"noreferrer noopener\">According to statements made by Interior Minister St\u00fcbgen in December 2022<\/a>, there are currently <strong>48 places for deportation custody and 60 places for transit <\/strong>(including rejections \/ refusal of entry and Airport Asylum Procedure) planned.<\/p>\n\n\n\n<p>Compared to the currently existing facility (\u201cAusreisesammelstelle\u201d) at BER this is a <strong><a href=\"https:\/\/www.fluechtlingsrat-brandenburg.de\/abschiebeknast-am-flughafen-ber\/\" target=\"_blank\" rel=\"noreferrer noopener\">huge increase of capacity. The present facility has 32 places (of which 24 are in use)<\/a><\/strong> used for deportation custody (under the authority of the Central Foreigners Office), \u201cAufgriffsf\u00e4lle\u201d and rejections\/refusals of entry (authority of federal police), Airport Asylum Procedure (authority of Federal Agency for Migration&nbsp; \u201cBAMF\u201d and federal police) as well as an assembly point for charter deportations.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Planned buildings<\/strong><\/h4>\n\n\n\n<p>The deportation centre is planned as a complex of buildings divided by functions, <a href=\"https:\/\/fragdenstaat.de\/dokumente\/181812-letter-of-intent-absichtserklaerung-zur-errichtung-und-vermietung-eines-behoerdenzentrums-am-flughafen-berlin-brandenburg-in-schoenefeld-ortsteil-alte-ortsmitte\/?page=1\">namely<\/a>:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>functional building complex <\/strong>which includes an \u201carrival centre \/ facility\u201d&nbsp; for the intake of Dublin cases from other EU member states, \u201cquota refugees\u201d and asylum seekers arriving via BER Airport), used by the ZABH, the BAMF and various other authorities (including the public prosecutor&#8217;s office, administrative court and local court) and including premises for canteen, security, laundry and other infrastructure functions<\/li>\n\n\n\n<li><strong>custody building <\/strong>for people in deportation custody<\/li>\n\n\n\n<li><strong>transit building <\/strong>(for the accommodation of people apprehended (\u201cAufgriffsf\u00e4lle\u201d), rejections \/ refusal of entry (\u201cZur\u00fcckweisungsf\u00e4lle\u201d) and persons in Airport Asylum Procedure<\/li>\n<\/ul>\n\n\n\n<p><mark style=\"background-color:#EEEADD\" class=\"has-inline-color has-black-color\">The <\/mark><mark style=\"background-color:#EEEADD\" class=\"has-inline-color has-black-color\"><strong>&#8220;repatriation&#8221; building <a href=\"https:\/\/fragdenstaat.de\/dokumente\/181691-neubau-rueckfuehrungsgebaeude\/\">(\u201cR\u00fcckf\u00fchrungsgeb\u00e4ude\u201d<\/a>)<\/strong>, originally planned as part of the deportation center is probably built as an independent project. We do not yet know which location is intended for this. The &#8220;repatriation&#8221; building should allow <a href=\"https:\/\/fragdenstaat.de\/dokumente\/181669-anhang-32\/\" target=\"_blank\" rel=\"noreferrer noopener\">the parallel processing of two charter deportations with up to 100 persons each at least once a week<\/a> as well as for individual deportations; operated 24\/7 with 45 officers by the federal police.<\/mark><\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Which authorities are involved?<\/strong><\/h3>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>The role of the Federal Agency for Migration and Refugees (BAMF)<\/strong><\/h4>\n\n\n\n<p>BAMF is responsible for:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>processing of Airport Asylum Procedures (\u00a718a AsylG)<\/li>\n\n\n\n<li>supporting deportations measures<\/li>\n\n\n\n<li>processing of asylum procedures of people entering by air (not \u00a718a AsylG): creation of case-file records (including identification and country-of-origin check), hearing and decision on asylum case, which are to take place <em>before<\/em> people are assigned to a first reception centre (\u201d\u201cErstaufnahmeeinrichtungen\u201d) \u2013 according to the BAMF this is to prevent people from discussing&nbsp; \u201ctactics\u201d on asylum applications.<\/li>\n\n\n\n<li>centralised processing point and competence centre for all follow-up asylum applications (\u201cAsylfolgeantr\u00e4ge\u201d) in BB as well as some other asylum applications<\/li>\n\n\n\n<li>return counselling<\/li>\n\n\n\n<li>Regional office branch Frankfurt Oder (Integration)<\/li>\n<\/ul>\n\n\n\n<p><strong>The BAMF is supposed to ensure the speedy processing of (follow-up) asylum applications so that planned deportation dates are not missed and people can be kept in deportation custody<\/strong>. In addition, the BAMF is meant to support individual and charter deportations of the state of BB, joint operations by several states (Bundesl\u00e4nder) or operations by Frontex supported by the federal government through monitoring, quality assurance and processing of urgent applications. The BAMF expects <strong>up to 350 airport asylum procedures per year, <\/strong>due, among other factors, to an increase of entries via air (mainly from Asia) and the expected classification of additional countries as \u201csafe countries of origin\u201d (e.g. Georgia).<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Role of Federal Police and the \u201crepatriation\u201d building<\/strong><\/h4>\n\n\n\n<p><mark style=\"background-color:#EEEADD\" class=\"has-inline-color has-black-color\">The <a href=\"https:\/\/www.parlamentsdokumentation.brandenburg.de\/starweb\/LBB\/ELVIS\/parladoku\/w7\/drs\/ab_4300\/4370.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">\u201crepatriation\u201d building<\/a> is to be used exclusively by the Federal Police with the primary function of processing deportations. The building will be rented directly by the federal government.<\/mark><\/p>\n\n\n\n<p><mark style=\"background-color:#EEEADD\" class=\"has-inline-color\">The Federal Police have been using the old Ryanair arrival hall at Terminal 5 since the beginning of 2023. The rent has been extended again and again, but the Federal Police was supposed to move into their own building by by the end of 2023 at the latest. There is therefore acute time pressure for them.<\/mark><\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Other actors<\/strong><\/h4>\n\n\n\n<p>The <strong>federal government<\/strong> (future tenant through the Bundesanstalt f\u00fcr Immobilienaufgaben, which received the <a href=\"https:\/\/fragdenstaat.de\/dokumente\/181688-anhang-50\/?page=1\" target=\"_blank\" rel=\"noreferrer noopener\">procurement contract<\/a> from BMI) is involved with BMI, Federal Police (BPOL) and BAMF <mark style=\"background-color:#EEEADD\" class=\"has-inline-color\">and is to become the sole tenant of the &#8220;repatriation&#8221; building<\/mark>.<\/p>\n\n\n\n<p>The <strong>state of BB<\/strong> is the building contractor and is involved in the project with the Ministry of the Interior (MIK) (Minister St\u00fcbgen, CDU), the Ministry of Finance and for Europe (Minister Lange, SPD, formerly Secretary of the Interior and at that time a proponent of the deportation center), the Ministry of Justice BB, the Central Foreigners Office, the state police and the judicial bodies of the state (Potsdam Administrative Court, K\u00f6nigs Wusterhausen Local Court, Potsdam Public Prosecutor&#8217;s Office).<\/p>\n\n\n\n<p>The <strong>district of Dahme-Spreewald<\/strong> is also expected to become a tenant. In addition, the Dahme Spreewald building authority grants the building permit and the <strong>municipality of Sch\u00f6nefeld <\/strong>is in charge of the development plan procedure.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Costs and allegations of corruption<\/strong><\/h3>\n\n\n\n<p><strong>What are the costs?<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Planned lease for <mark style=\"background-color:#EEEADD\" class=\"has-inline-color\">25 years<\/mark><\/li>\n\n\n\n<li><mark style=\"background-color:#EEEADD\" class=\"has-inline-color\"><a href=\"https:\/\/www.zeit.de\/news\/2023-11\/08\/finanzministerium-gibt-mittel-fuer-geplantes-asylzentrum-frei\">Annual rent of 8.38 MIO \u20ac<\/a> (St\u00fcbgen 11\/23) for authorities centre (\u201cBeh\u00f6rdenzentrum\u201d) + probably another 6.6 MIO \u20ac for the \u201crepatriation\u201d building<\/mark> (as of <a href=\"https:\/\/fragdenstaat.de\/dokumente\/181812-letter-of-intent-absichtserklaerung-zur-errichtung-und-vermietung-eines-behoerdenzentrums-am-flughafen-berlin-brandenburg-in-schoenefeld-ortsteil-alte-ortsmitte\/?page=1\">Letter of Intent 10\/21<\/a> \u2013 but that document has never been signed)<\/li>\n\n\n\n<li>According to <a href=\"https:\/\/taz.de\/Geplantes-Abschiebezentrum-am-BER\/!5872034\/\">media reports from August 2022<\/a> the investor could make up to 315 MIO \u20ac with the construction of both building complexes (authorities center + &#8220;repatriation&#8221; building).<\/li>\n<\/ul>\n\n\n\n<p><mark style=\"background-color:#EEEADD\" class=\"has-inline-color\">By making the federal government rent the &#8220;repatriation&#8221; building, these costs no longer appear in the household of the state of Brandenburg. In this way the state government aims to cease the strong criticism of the entire project, as can be seen from internal correspondence.<\/mark><\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Criticism of tender procedure and corruption charges against the investor<\/strong><\/h3>\n\n\n\n<p>The investor is J\u00fcrgen B. Harder, who has already built a <a href=\"https:\/\/www.rbb24.de\/wirtschaft\/beitrag\/2022\/05\/ber-behoerde-zentrum-streit-investor-harder-partner-hallenbauer.html\" target=\"_blank\" rel=\"noreferrer noopener\">hangar<\/a> at BER. In 2015 he was<strong> sentenced to <a href=\"https:\/\/www.rnz.de\/region\/metropolregion-mannheim_artikel,-Metropolregion-Harder-schrammt-im-Frankfurter-Korruptionsprozess-an-Haftstrafe-vorbei-_arid,144603.html\" target=\"_blank\" rel=\"noreferrer noopener\">two years probation<\/a> <\/strong>by the Frankfurt\/Main regional court for his involvement in a bribery scandal related to the expansion of Frankfurt airport. <mark style=\"background-color:#EEEADD\" class=\"has-inline-color\">In the following years he was involved in a <a href=\"https:\/\/www.sueddeutsche.de\/wirtschaft\/uniklinikum-heidelberg-bluttest-boersenmanipulation-1.4422883\">medical scandal<\/a> at Heidelberg University, the allegation is insider trade with a startup that has distributed an unusable blood test to detect breast cancer.<\/mark><\/p>\n\n\n\n<p>Why is the state of BB assigning a private investor in the first place? <strong>It is suspected that the then SPD Ministry of Interior aimed to bypass the then Finance Minister from the Left (G\u00f6rke)<\/strong> (see above &#8220;replacement of Eisenh\u00fcttenstadt detention facility&#8221;). An <a href=\"https:\/\/fragdenstaat.de\/dokumente\/176970-briefing-von-herrn-st-e\/\" target=\"_blank\" rel=\"noreferrer noopener\">internal communication of the BMI (01\/19)<\/a> reads: \u201cAs the Finance Minister is a member of the Left-Party, the Minister of Interior does not want to construct a building himself, but to have it built by and then lease it from an investor\u201d. By having it built by an external investor, the costs only appear in the state budget with the first rental payments due when construction is completed. <a href=\"https:\/\/www.rbb24.de\/politik\/beitrag\/2022\/08\/berlin-brandenburg-flughafen-ber-investor-stuebgen.html\" target=\"_blank\" rel=\"noreferrer noopener\">If the state built the project itself, the state finance minister would have needed to be involved as early as 2018.<\/a><\/p>\n\n\n\n<p>But why was Harder brought on board as an investor? At the beginning of May 2022, St\u00fcbgen declared in front of the Brandenburg Interior Committee to be talking with Harder since 2018, at that point Harder owned the only plots of land available at the airport. In 2017, when the planning started, Harder owned only two small plots of land north of the planned construction site, where a significantly smaller deportation center was originally planned. The decision to change the location and increase the scope of the deportation center is said to have only been made in 2020.
